Terms and Conditions

Welcome to the terms and conditions of Tadamon. These terms and conditions (“Agreement”) set forth the general terms and conditions of your use and access to website www.tadamon.world, Tadamon’s mobile application, platforms (“Platforms”), and any associated services, including without limitation Donations as defined hereunder (“Services”), owned, operated and provided by Tadamon For Societal Development, a non-profit limited liability company incorporated in the Hashemite Kingdom of Jordan, its assets, subsidiaries, affiliates, agents, representatives, consultants, employees, and directors (collectively “Tadamon”). This Agreement is legally binding between you and Tadamon. By downloading, installing, accessing the Platform and/or using the Platform or any part of the Platform and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. 

 

The access and use of our Platform and the Services are also governed by Tadamon’s privacy policy (“Privacy Policy”) and other relevant policies, which are incorporated herein by reference. This Agreement along with Tadamon’s Privacy Policy affect your legal rights and obligations. If you do not agree to this Agreement and/or the Privacy Policy, your only remedy is to discontinue your use of the Platform and Services.

 

This Agreement constitutes a contract between you and Tadamon and applies to all users of the Platform and/or Services. Any person or entity using the Platform, is compliant to Tadamon’s terms and conditions set out hereunder. Provided that if such person is under 18 years of age or the age of majority in your jurisdiction, whichever is older, it also includes such person's parent or legal guardian consent.

 

This Agreement applies to all Users of the Platform in whatever capacity, including non-registered users, users with a registered account, donors, organizers, and any other person. By accessing, using or registering an account with the Platform, or by using any of our Services offered through the Platform, you agree to be bound by this Agreement.

 

You therefore expressly and unreservedly accept this Agreement and confirm that you are eligible to use the Platform and Services. Your continued use of our Platform and/or Services now or following any changes to this Agreement indicates your acceptance of this Agreement and any changes thereafter. If you do not wish to be bound by this Agreement, you are kindly requested to immediately refrain from using our Platform. In addition, by accessing and using our Platform, you agree to fully comply with all the terms and conditions stipulated herein in conjunction with the applicable laws and regulations of the Hashemite Kingdom of Jordan.

Interpretation

 

Unless otherwise indicated and for the purpose of this Agreement and wherever the context so requires, the following terms shall have the following meanings:

 

“Content(s)” shall refer to any or all information, products, services, items, materials, promotional programs, pictures, images, videos, featured articles, texts, advertisements, messages, numbers and all components relevant to the Platform and/or this Agreement in whatever format or type, whether such Content is provided by you, other users, third party, and/or Tadamon.

 

“Donation(s)” shall refer to the amount of money donated by any registered Eligible User on the Platform which has been accepted by Tadamon;

 

“Intellectual Property Rights” shall mean all present and future rights in relation to any copyright and related rights, trademarks, designs, patents, inventions, rights to inventions, rights to use, and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, rights to claim priority from, such rights and all similar or equivalent rights or forms of protection and any other results of intellectual activity which subsist or will subsist now or in the future in any part of the world.

 

“Tadamon”, “we”, “us” and “our” shall refer to Tadamon for Societal Development and/or any of its Platform(s) and/or affiliates as the case may be.

 

“User(s)”, “you” and “your” shall refer to any visitor, user or person who accesses to, or uses the Platform in any manner whatsoever.

Accounts and Membership

You may browse the Platform without the need to register an account, however, please note that to make any Donations, creating an account on our Platform, is available only to individuals of the Jordanian nationality that are permitted to donate under the applicable laws of the Hashemite Kingdom of Jordan (“Eligible Users”). The Platform is an online platform where the Eligible Users may donate money for the support of cases targeting social or community causes ("Cases"). 

 

You must be at least 18 years of age to use the Platform, Services and payment methods displayed on the Platform. By using the Platform and Services and by agreeing to this Agreement you warrant and represent that you are at least 18 years of age.

 

The User is responsible for every activity that takes place on its account and is also responsible for maintaining the confidentiality of the password to the account created. If the User discovers that someone is using his account without his prior permission, this must be reported to (hello@tadamon.world).

 

If you create an account on the Platform, you are responsible for maintaining the security of your account and you are fully responsible for all the entered information, all activities that occur under the account and any other actions taken in connection with it. We may, but have no obligation to, monitor and review new accounts before you may sign in and start using the Platform and Services. Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we delete your account for the foregoing reasons, you may not re-register for our Platform or Services. We may block your email address and Internet protocol address to prevent further registration.

 
Tadamon provides an online platform which accepts electronic Donations from Eligible Users for the support of the beneficiaries in the Hashemite Kingdom of Jordan, allowing the Eligible Users to donate easily and safely. Tadamon also allows selected Users (“Community Contributor(s)”) the option to contribute and post Cases on the Platform. The Case(s) are only posted on the Platform once the Case(s) have been verified - according to available verification methods from Tadamon; the Community Contributor’s name will be attributed to the Case. 

Donations via the Platform

We process Donations made on Tadamon’s Platform and Services through third-party payment processors. Once you confirm through the Platform that you wish to proceed with your Donation, your transaction will be processed through our payment services providers, MEPS, eFAWATEERcom and any of their affiliates, as well as e-Wallet providers (“Payment Services Providers”). By confirming that you wish to proceed with your Donation, you authorize our Payment Services Providers, as the case may be, to process the specified amount from your card provider.

 

You understand that you are solely responsible for ensuring that you have selected the desired Case to donate to and have provided a valid and authorized payment method for making the Donation.

 

Donations processed are complete and final, and refunds are not allowed once the Donation has been made. 

Supporting Tadamon

The Platform enables Eligible Users to donate money in support of the operation and services provided by Tadamon (“Support Donation”).

 

Support Donation can be refunded. However, the request must be made within one (1) day from such Support Donation being processed by sending an email to hello@tadamon.world stating the following:

1. Name, email, mobile number of the Eligible User which donated/donor;
2. Title of the Case;
3. Donated amount (stating both the Donation and the Support Donation); and
4. Date of donation.

 

If a mistake in the amount of the Support Donation was made and a refund was requested pursuant to the above stated points (i.e. a higher amount was donated by mistake; such as $500 instead of $50), we encourage you to reach out to our team directly on hello@tadamon.world and inquire if your Support Donation is eligible for a refund. 

Payment Cards and Transactions

Certain aspects of our Platform or Services may require you to agree to the terms of third-party service providers (e.g. payment processors) in order to utilize the Services. You may not use the payment services for any different purpose than as registered with our Platform. Tadamon reserves the right to suspend or terminate your use and access to the Platform or our Services with immediate effect. 

 

How to pay

Through the Eligible User’s account on the Platform, the Eligible User, once have made the selection to the Case, will be guided through to process the Donation and Support Donation payment. The method of payment on the Platform is either by Credit Card, Debit Card, Visa Card, MasterCard, e-wallets or any other method adopted by our Payment Services Providers via secure payments system which is linked directly with our Payment Services Providers.  We do not capture or store your card details, only to the extent required as stated under the Privacy Policy. 

 

Payment currency

All transactions are processed in Jordanian dinars (or any other currencies provided on the Platform).

 

Multiple transactions may result in multiple postings to the cardholder’s monthly statement (User’s monthly statement). 

Links to Other Resources

Although the Platform and Services may link to other resources (such as websites, Platforms, etc.), we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked resource, unless specifically stated herein. We are not responsible for examining or evaluating, and we do not warrant the offerings of any businesses or individuals or the content of their resources. We do not assume any responsibility or liability for the actions, products, services, and content of any other third parties. You should carefully review the legal statements and other conditions of use of any resource which you access through a link in the Platform. You also acknowledge that Tadamon does not accept any liability pertaining to provision of these resources, and may not be held liable as to the content therein. You further acknowledge that your linking to any other off-site resources is at your own risk.

 

Therefore, Tadamon makes no warranties or guarantees as to the accuracy and authenticity of third party and other resources provided by any third party or user, and shall not be liable or responsible thereof, without limitations, for any loss, damages or otherwise which you may endure for accessing any such contents or resources or using and relying on such contents. If you link to and/or use any third party links, platform(s), applications, services or otherwise, you agree to do so at your own risk and you acknowledge that when you access or use such content, resources or services, their own terms and privacy policies will govern such access and use.

Content(s)

All Content(s), materials on the Platform, other than user contents and/or third-party content, as the case may be, including without limitations, the Platform, listed Cases, texts, software, scripts, cases, graphics, photos, sounds, music, videos, interactive features, trademarks, logos contained therein, are the sole property of Tadamon or its affiliated companies, licensed by Tadamon or used with permission by Tadamon. Nothing herein, shall be construed to grant you any rights in relation to such Content and in no event, must be used, copied, reproduced, transmitted, sold, licensed, or otherwise exploited without obtaining a prior written consent of Tadamon.

 

You shall be solely responsible for your Personal Information as defined under Tadamon’s Privacy Policy, and Content, transmitted, published, uploaded, emailed, or otherwise made available through the Platform. More specifically, you are responsible for each individual item of Content that you make available via the Platform. Therefore, you acknowledge, warrant and affirm that you have all necessary permissions, licenses and rights to use such Content. Tadamon may store user Content, details, and Personal Information indefinitely, subject to this Agreement and Tadamon’s Privacy Policy. However, Tadamon has no obligation, responsibility or shall be deemed liable thereof to store user Content or make it available to you at any time.

 

You acknowledge and agree that Tadamon has the right, at its sole discretion, to modify and amend the Content and the Platform features from time to time without notifying you. Notwithstanding the above, Tadamon is not responsible in any way of any user and/or third party’s Content available at the Platform.

Prohibited Uses

In addition to other terms as set forth in the Agreement, you are prohibited from using the Platform and Services or Content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Platform and Services, third party products and services, or the Internet; (h) to spam, phish, pharm, pretext, spider, crawl, or scrape; (i) for any obscene or immoral purpose; or (j) to interfere with or circumvent the security features of the Platform and Services, third party products and services, or the Internet. We reserve the right to terminate your use of the Platform and Services for violating any of the prohibited uses.

Intellectual Property Rights of Tadamon

The Platform and all the Content, available thereunder, provided by Tadamon, and the Intellectual Property Rights, is the sole and exclusive property of Tadamon, notably including the Platform content, namely text, logos, images, and other distinctive signs. You hereby undertake not to harm, directly or indirectly via the intermediary of a third party, the Intellectual Property Rights of Tadamon over the Platform. You hereby refrain from reproducing any element of the Platform and/or Content, republish, sell, rent, sub-license, duplicate, copy or redistribute any Content from the Platform and/or Intellectual Property Rights, by any means whatsoever, in any form whatsoever and on any medium whatsoever, without the prior written consent of Tadamon. 

 

This Agreement does not transfer to you any Intellectual Property Rights owned by Tadamon or third parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with Tadamon. All trademarks, service marks, graphics and logos used in connection with the Platform and Services, are trademarks or registered trademarks of Tadamon or its licensors. Your use of the Platform and Services grants you no right or license to reproduce or otherwise use any of Tadamon or third party trademarks.

 

You hereby acknowledge and agree that Tadamon does not permit, authorise or condone and hereby expressly prohibits any user from accessing or using the Platform in a manner that infringes, or is likely to infringe, the Intellectual Property Rights (all industrial, commercial and intellectual property rights), or any other rights or privileges, of any person anywhere in the world.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Tadamon, its affiliates, directors, officers, employees, agents, suppliers or licensors be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if the liable party has been advised as to the possibility of such damages or could have foreseen such damages.

 

The legal responsibilities and liability of Tadamon are either limited or excluded pursuant to this Agreement; as you take on risk, full responsibility of using the Platform provided. You acknowledge and agree to defend, indemnify, and hold Tadamon, its officers, subsidiaries, affiliates, successors, directors and employees harmless from and against any and all claims, damages, obligations, losses liabilities, costs, debts or expenses (including legal fees) arising out from, in connection with or related to:

1. Any violation of any of the terms of this Agreement; 
2. Any violation of any applicable laws and regulations in the Hashemite Kingdom of Jordan and/or in jurisdiction which the Content is posted or received or that you are a resident of.
3. Any violation of any third party intellectual rights, including without limitations any copyright, trademark, or trade secret;
4. Any claim related to any damage, loss, loss of business or otherwise, that your Content, way of use and actions may have caused to Tadamon, user or any third party;
5. In all cases, you agree that Tadamon shall not be liable for any damages of any kind resulting from any aspect of your use of the Platform.

 

You are subject to all laws of the country in which you reside and from which you access the Platform and you are solely responsible for obeying those laws. Tadamon cannot be held liable if laws applicable to you restrict or prohibit your access, use, or participation of the Platform or Services. Tadamon makes no representations or warranties, implicit or explicit, as to your legal right to access or participate in the Platform or Services, nor shall any person affiliated, or claiming affiliation, with Tadamon have authority to make any such representations or warranties. Tadamon reserves the right to monitor the location from which you access the Platform and to block access from any jurisdiction in which the access, use or participation is illegal or restricted.

Indemnification

You agree to indemnify and hold Tadamon and its affiliates, directors, officers, employees, agents, suppliers and licensors harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys’ fees, incurred in connection with or arising from any third party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Platform and Services or any willful misconduct on your part.

Force Majeure

The Platform is accessible online 24/7, aside for in any case of force majeure, any event outside the control of Tadamon and/or the Platform host, and any breakdowns or maintenance required for proper operation of the Platform. Which will not lead to any compensation. You confirm that you are aware and accept the characteristics and limits of information transfer online, as well as costs pertaining to connection to the Internet. Tadamon expressly reserves the right, without compensation, to amend the Platform in whole or in part at any time as well as its presentation or medium and to interrupt update of the Platform without notice. The liability of Tadamon may under no circumstances be incurred for any direct, indirect, incidental, special or consequential damages whatsoever suffered by yourself, any user or any third party, resulting directly or indirectly from access and use of the Platform or inability to access and use the Platform. 

Privacy and Security Measures

Tadamon has developed a detailed Privacy Policy incorporated into this Agreement, which governs the information and data privacy obtained from users. Which you also agree on, and acknowledge that the Privacy Policy constitute an integral part of this Agreement. 

 

You acknowledge and agree that Tadamon provides the Platform and Services on an "as is" and "as available" basis. Nothing in this Agreement shall or may be construed as a representation or warranty by Tadamon that the functionality or operation of the Platform and/or Services will meet your requirements, be uninterrupted or free of errors and inaccuracies, or even operate in the configuration or with the hardware or software used by you.

Severability

All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force and effect.

Dispute resolution

This Agreement shall be governed by and construed in accordance with the applicable laws of the Hashemite Kingdom of Jordan. Any dispute, controversy or claim arising out of, or relating to or in connection with interpretation, implementation and enforcement of this Agreement shall be referred to the sole jurisdiction of the Central Court of Amman (the Palace of Justice).

Changes and Amendments

We reserve the right to unilaterally modify and amend this Agreement or its terms related to the Platform at any time at our discretion. You hereby agree to abide by and be fully bound by such modified and amended terms even if they are in conflict with this Agreement or subject you to additional obligations. When we conduct such modification and amendments, we will revise the updated date at the top of this page. 

 

You are solely responsible for reviewing this Agreement from time to time as the Agreement may be automatically updated, changed or modified by Tadamon at any time and at its discretion. An updated version of this Agreement will be effective immediately upon the posting of the revised Agreement and Tadamon will not be responsible to inform or notify you of such amendments or modifications, therefore, You must review the Agreement on a regular basis. Your continued access and use of the Platform and Services after the effective date of the revised Agreement (or such other act specified at that time) will constitute your unconditional acceptance and consent to those changes and amended terms and modifications.

 

If you do not agree to be automatically bound to any amendments and/or modifications to this Agreement or to any of the current terms or policies attached or referred to hereunder, you must cease and stop using the Platform and Services immediately.

Acceptance of These Terms

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By accessing and using the Platform and Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to access or use the Platform and Services.
